We only process and use personal data if it is necessary for operating our website and providing you the services offered on our website.
When you access and use our website, we only collect the personal data that your browser automatically transmits to our server (IP address, date and time of access, name and URL of the retrieved file, website from which access is made, the used browser and, if applicable, the operating system of your computer as well as the name of your access provider). The legal basis for processing the above referenced data is Art. 6 para. 1 GDPR as it is necessary for the provision of our services and protects a legitimate interest of our Company.

If you complete a contact information form that we offer on one of our Company websites or at a trade show, we will ask for your

On our website you can register for our newsletter using your email address. If you provide your email address, we will use it to contact you personally about product spotlights, job case studies, parts promotions, company news and other marketing communications on a regular basis.

2.5 Telematics
If our equipment that includes a telematics system is sold under agreement with the separate Telematics Terms of Use (“Terms of Use”), the telematics system is administered by a third party (“Teleservice Provider”) and collects a range of operational data about the equipment including, but not limited to, condition, usage, performance and reliability. Terex obtains this data to display it to the customer in the telematics web application so that the customer can get an overview of the performance and maintenance status of the equipment used in the operation. Regarding the underlying terms of use (“Terms of use”), the legal basis for the processing of the data generated during the use of the account is Art. 6 para. 1 b) GDPR in conjunction with the legitimate interest (of the Customer) within the meaning of Art. 6 para. 1 f) GDPR to make the telematics data available exclusively to users authorized by the Customer Company and to treat the equipment data confidentially as internal company information to this extent ("Client Separation"). The storage period of the account data amounts to the duration of the individual authorization by the "owner" on the part of the customer, who continuously administers the users authorized to access the telematics data. The account data is deleted accordingly when the individual authorization expires (e.g. when an employee leaves the customer company). While access to the web application is secured via a personalized account, Terex does not establish a link between the equipment data itself and the vehicle operators in charge of the equipment, whose identity is unknown to Terex.
Terex uses the product-related telematics data of the equipment for its own purposes for warranty, for product improvement based on the analysis of any sources of problems, as far as possible for marketing purposes in relation to its own goods and services and, where appropriate, as part of the accompanying customer support. Terex may also collect, manage and report data (personal and non-personal) about the equipment including, but not limited to, fuel consumption, up/down times, operation, defects, parts replacement, movement and location. Your use of any telematics services, equipment or data shall be subject to the current version of the Terex Telematics Terms of use at https://www.terex.com/en/products/telematics-tou.
2.6 Terex Financial Services
We collect your personal information so that we can consider any application you make to us, establish and administer the financial product or service provided to you, provide services to you in relation to that product or service, perform administrative functions, conduct customer satisfaction research, improve our products and develop new products, assist you to manager your debts, provide information about you to a guarantor or prospective guarantor, and so that we and our related parties and corporate partners can tell you about other products and services you may be interested in.
In certain circumstances, we may also be required to collect sensitive information about your health, for example when you make an application for assistance with financial hardship caused by illness or injury. We may collect this information from third parties, for example a doctor or a hospital.
Further, we may collect and use your personal information to comply with legislative and regulatory requirements. We will need to know:
- Your name, date of birth, address and occupation;
- If we open an Account for you, details of the name of the Account, whether the Account will be held in trust, and details of all signatories to the Account;
- Details of your beneficial owners including name, address and date of birth.

3. What do we use your personal data for?

4. Where is your personal data transferred?
The Terex Corporation website is hosted in the United States. We also integrate social media sites into our website. The integration takes place via a linked graphic of the respective site. The use of these graphics stored on our own servers prevents the automatic connection to the servers of these networks for their display. Upon request, we would be happy to disclose to you which of your personal details we have on file. Should you request that we delete the personal data we have stored, once we receive your request, we will delete this data immediately. CHINA ADDENDUM
This China Addendum to the Terex Privacy Policy (the “Policy”) applies when our collection and processing of your personal data is subject to the applicable Chinese data protection legislation. The terms set out in this China Addendum are in addition to the terms set out in the Policy and form an integral part of the Policy.
